Is it legal for a prosecutor to authorize the arrest of one brother for drugs,?

Is it legal for a prosecutor to authorize the arrest of one brother for drugs, to gain leverage so he could have evidence against his brother, even though the prosecutor knows the charge will be thrown out, and the accused would lose a scholarship to college? If it is legal, is it ethical? Why or Why not?
